By accessing, registering, or using the Rentamira Web App (“the App”), the user (“you” or “the User”) signifies their explicit acceptance of these terms and conditions (“Terms”) in their entirety. If you, as a User, disagree with any portion of these Terms, you are instructed to cease all use of this App forthwith.
2. Description of Service
Rentamira offers a specialized service platform for users involved in short-term rental operations. The App’s primary function is to facilitate a deeper understanding of a User’s property listing by analyzing competitors, guest demographics, and other market intelligence. This analysis leads to content and marketing strategies optimized to the User’s unique position in the market.
3. Registration, User Data, and Confidentiality
a. To gain full access and leverage the App’s functionalities, Users may be required to undergo a registration process. b. It is incumbent upon the User to provide accurate, timely, and complete information during this process. Any falsification or omission can lead to suspension or termination of the User’s account. c. Rentamira will exert reasonable efforts to ensure the confidentiality of User information. However, it cannot be held liable for breaches beyond its control.
4. Pricing, Payment, and Refund Policies
a. Rentamira offers differentiated pricing structures: Basic (USD 39.99/month) and Pro (USD 49.99/month). b. Discounted rates for annual commitments are USD 39.99/month for Basic (with a 12-month lock-in) and USD 49.99/month for Pro (also with a 12-month lock-in). c. Payments once made are irrevocable and non-refundable, barring exceptional circumstances as determined by Rentamira in its sole discretion
5. User Responsibilities and Conduct
a. Users maintain the sole responsibility for all data inputs, notably the Airbnb URL and any preference configurations. b. Users are explicitly prohibited from using the App in manners that violate any applicable laws or regulations. c. Users shall refrain from any actions that could detrimentally affect the functionality or reputation of the App.
6. Intellectual Property Rights and License
a. All proprietary content, including but not limited to textual, graphic, and software elements, generated by Rentamira remains the exclusive property of Rentamira, protected under applicable copyright and intellectual property laws. b. The User is granted a limited, revocable license to use said content solely for the purpose outlined in the App’s functionalities and not for any unauthorized or commercial purpose.
7. Data Privacy, Protection, and Usage
a. Rentamira holds all User data in strict confidence and ensures adherence to prevailing data protection regulations. b. Data collation serves the primary purpose of enhancing the User experience and facilitating the App’s primary functions. c. Rentamira refrains from selling, leasing, or sharing User data with third parties without explicit, informed User consent, barring legal obligations.
8. Limitation of Liability and Indemnifications
a. Under no circumstances shall Rentamira be held liable for any consequential, incidental, indirect, punitive, or special damages arising from or related to the use, misuse, or inability to use the App. b. The User agrees to indemnify and hold harmless Rentamira, its affiliates, officers, and employees from any claims or damages, including legal fees, made by third parties due to or arising out of the User’s conduct, violation of these Terms, or infringement of any intellectual property rights.
9. Termination and Cancellation Policies
a. Rentamira reserves unilateral rights to suspend or terminate User access for any violations of these Terms or other detrimental behaviors. b. For annual plan Users, a strict 12-month commitment applies. Premature termination or withdrawal will invoke stipulated cancellation fees, as defined by Rentamira.
10. Amendments and Modifications to the Terms
a. Rentamira retains the right to periodically amend, augment, or revise these Terms at its discretion. b. Users will be duly notified of such changes, and continued usage post-modification signifies User acceptance thereof.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the state of Delaware, and any disputes arising shall be subject exclusively to the jurisdiction of the courts of Dover.
